The Von Duprin Panic Exit Device 3327A and 3527A Top Latch 050400 is now online and in stock for immediate delivery!  This Von Duprin Top Latch has been around since July of 2002.  If you bottom Rod or Latch is dragging on the floor, the top latch is usually the problem.  The Von Duprin Top Latch 050400 keeps the bottom rod or latch retracted while the door is open, as soon the Top Latch 050400 hits the strike the latch releases the rod, and allows it to drop.
